1 - Scope of application of the terms of sale

These general terms and conditions automatically govern all sales of stays made via the website www.olydea.com. They form an integral part of any contract concluded between the Olydea Group and its clients.

Each client acknowledges having read these general terms and conditions prior to booking a stay, both for themselves and for any other occupants of the accommodation.

In accordance with applicable law, these general terms and conditions are made available to clients for informational purposes prior to the conclusion of any sales contract for a stay. They may be requested via email at contact@olydea.com or viewed at www.olydea.com.

2 - Booking conditions

2.1 Prices and payment

The price of stays is quoted in euros, inclusive of VAT. Clients are advised that the quoted rate excludes the tourist tax, which must be paid on-site upon arrival.

For rental bookings: all rentals are personal and non-transferable. A rental booking only becomes effective upon our confirmation and receipt of the full cost of the stay and the booking fees.

The client signing the fixed-term contract may not, under any circumstances, claim any right to remain on the premises after the stay has ended. The duration of the stay shall correspond to that specified in the rental contract.

Pursuant to Articles L.441-6 and D.441-5 of the Commercial Code, late payment penalties at an annual rate of 12% and a fixed indemnity of €40 are payable if payment is not made by the day following the payment date shown on the invoice.

2.2 Utilities and cleaning

Utility charges are included in the rental price.

For stays of fewer than 7 nights, cleaning is included in the advertised rate. For stays of 7 nights or more, cleaning is the tenant's responsibility. Tenants may opt for a cleaning service package if they wish. The rate varies depending on the accommodation type and can be obtained by calling the residence.

2.3 Booking

A booking becomes confirmed once the full cost of the stay has been paid (excluding the tourist tax). A confirmation email will then be sent to the client's email address.

Rate with cancellation up to 7 days prior to arrival: Payment is due at the time of booking. Cancellation is free of charge up to 7 days before the arrival date.

In accordance with regulations, each accommodation type has a maximum occupancy limit. No additional sleeping arrangements may be added to the units.

2.4 Booking modifications and early departure

No price reductions will be granted for late arrivals or early departures.

If the client cuts their stay short, no refund will be issued unless the reason for the interruption is covered by the optional cancellation insurance purchased by the client at the time of booking.

2.5 Cancellation

Any booking not fully paid in accordance with the General Terms and Conditions of Sale will be cancelled.

Rate with cancellation up to 7 days prior to arrival: Cancellation is possible and free of charge up to 7 days before arrival; beyond this deadline, no refund will be issued in the event of cancellation or a no-show.

For any cancellation initiated by the Olydea Group—except in cases of force majeure—the client will receive a full refund of all amounts paid. 2.6 Right of Withdrawal

The statutory provisions regarding the right of withdrawal for distance selling, as set out in the Consumer Code, do not apply to tourism services (Article L.121-20-4 of the Consumer Code). Consequently, the customer has no right of withdrawal for any booking of a stay at the Residence.

2.6 Cancellation Insurance – Holiday Liability Insurance

Certain rates include cancellation insurance valid up to a specific date prior to check-in.

However, it is also possible to purchase cancellation insurance offered by the external provider "Gritchen" via the following link: https://www.souscription.safebooking.com/olydea-hotels-residences/. Olydea shall under no circumstances be held liable in the event of a dispute between Gritchen and the customer.

In the absence of cancellation insurance, the customer is liable for any damage caused by their actions. Customers are advised to check whether their personal insurance policies include "holiday liability" coverage. If not, they are strongly recommended to take out such a policy.

3 - Stay Details

3.1 Arrivals and Departures

Check-in takes place between 4:00 PM and 7:00 PM. For late arrivals, a key box system is available at each residence. Guests must contact the residence the day before or on the day of arrival to obtain check-in instructions.
No refunds will be issued for services not utilized due to such delays.
Check-out must take place by 10:00 AM on the scheduled departure day.
Returning keys or vacating the accommodation after 10:00 AM will result in a charge for an additional night.

3.2 Security Deposit

A security deposit is required for all rental accommodations upon arrival (via credit card pre-authorization or cheque). It will be refunded on the day of departure—during office hours—following an inspection of the premises.
An inventory of the rented accommodation will be conducted at the end of the stay.
Compensation will be required for any loss or damage. Charges for any damage found will be added to the cost of the stay, as will cleaning fees if the accommodation is not left in a perfectly clean condition. If the guest is not present for the inspection, the security deposit will be automatically voided/destroyed provided there are no issues to report.

3.3 Pets

Pets are permitted, with a maximum of two per accommodation. A surcharge applies; rates can be obtained by calling the residence directly. The residence reserves the right to refuse pets belonging to restricted breeds.
The guest remains liable for any damage caused to the premises. In the event of damage, the client is held fully liable and will be billed for the cost of necessary repairs or restoration. Pet owners must ensure consideration for other occupants (regarding noise, cleaning up waste, etc.) and maintain proper control over their animals. All pets must be kept on a leash.

3.4 House Rules

As required by law, the client must comply with our house rules, which have been filed with the prefecture and are displayed at reception; a copy is available upon request.

4 – Liability and Complaints

Any complaints regarding the rental unit, the property description, or the condition of the premises upon arrival must be submitted no later than the third day of the stay (excluding issues arising after that time). The tourist accommodation facility shall not be held liable if it can prove that the non-performance or improper performance of the contract is attributable to the client, to the unforeseeable and unavoidable act of a third party unconnected to the provision of the services specified in the contract, or to a case of *force majeure*.

5 - Personal Data

In accordance with the provisions of Law No. 78-17 of January 6, 1978, regarding data processing, files, and individual liberties, the client has the right at any time to access, rectify, or object to the use of personal data concerning them that was collected when placing an order with the tourist accommodation facility.

6 - Proof of Electronic Orders

It is expressly agreed between the parties that, in accordance with the provisions of Articles 1316 *et seq.* of the Civil Code, information recorded by the Olydea Group's information systems constitutes valid evidence between the parties. Records regarding the receipt or transmission of data exchanged between the parties, as held in the Olydea Group’s information systems, shall prevail unless the client provides written proof to the contrary. Information provided by the Olydea Group’s information systems shall have the same evidentiary value as a document on paper.
In accordance with the provisions of Article L. 134-2 of the Consumer Code, the Olydea Group will archive electronic orders for a period of 10 years from the date of delivery. The relevant client may request access to the archived documents by following the procedures set out in Article 16 above.

7 - Applicable Law

These General Terms and Conditions are governed by French law, and specifically by the provisions of the Tourism Code; any dispute relating to their application falls within the jurisdiction of the *Tribunal de Grande Instance* (Regional Court) or the *Tribunal de Commerce* (Commercial Court) of La Roche-sur-Yon (85).
Documents and information exchanged between the client and the tourist accommodation facility are drawn up in French.
