Rental accommodation and camping pitches

1. Purpose and scope
These General Terms and Conditions of Sale (hereinafter the “Terms”) govern bookings for stays on camping pitches and in rental accommodation at Camping La Roucateille, operated by SAS Occitanie Loisirs Émotion, 15 rue du Pradal, 09330 Montgailhard, France.
Any booking implies that the customer has read and unconditionally accepts these Terms as well as the campsite rules. Where applicable, any special conditions stated in the contract, quotation or booking confirmation specify the services specific to the stay.
The campsite provides tourist and family-oriented stays. It reserves the right to refuse any booking that is incompatible with the capacity of the accommodation or pitches, applicable regulations, the campsite rules or the nature and purpose of the establishment.

2. Booking
2.1 Formation of the booking and personal nature of the booking
The booking becomes binding once it has been accepted by the campsite and the advance payment has been received or, where the booking is made within the period referred to in Article 4, once the full amount due has been received, and once these Terms have been accepted for an online booking or the contract has been returned where a written contract is used.
The booking is made in the customer’s name and is personal to them. It may not be transferred or sublet without the campsite’s prior written consent. The person making the booking must be an adult and is responsible for all participants registered for the stay.
Minors who are not accompanied by their parents or legal guardians are not admitted, except with the campsite’s prior written agreement in specific circumstances.

2.2 Camping pitches
The campsite offers several categories of pitches, which may have different characteristics, facilities and prices. Customers must refer to the descriptions and rates in force at the time of booking.
The basic package includes a pitch for a tent, caravan, motorhome, campervan or converted van, for 1 or 2 people depending on the rate booked, together with access to the sanitary facilities and communal facilities included in the stay. The maximum permitted occupancy is that stated in the descriptions and rates in force and may not exceed the limits set by the campsite.

2.3 Rental accommodation
Rental accommodation is equipped in accordance with its commercial description. Its maximum occupancy must be strictly observed, including babies. The campsite may refuse access to accommodation if the number of participants exceeds its authorised capacity.
Facilities, included services and optional extras vary according to the category of rental accommodation. Customers must refer to the accommodation description and the rates in force at the time of booking.

2.4 Choice of a specific pitch or rental unit
Subject to availability, customers may request a specific pitch or rental unit number. This option is available for an additional charge, the amount of which is shown in the rates in force.

2.5 Groups
Any booking for more than 15 people made by the same person, or by several people who know each other and are travelling together on the same dates, may be treated as a group booking. Any group request may be reviewed and made subject to specific conditions before it is accepted.

3. Prices, taxes and services
The applicable prices are those in force at the time of booking and confirmed in the contract or booking confirmation. They are stated in euros, including VAT at the rate in force, unless otherwise stated.
Tourist tax is collected at the rate and under the rules set by the competent local authority. Where an eco-contribution applies, the customer is informed accordingly.
Optional services, supplements and purchases are charged at the rates in force when they are ordered. Customers are invited to consult the current price list for the applicable amounts.

4. Payment terms
Any sums paid in advance when booking constitute an advance payment towards the price (acompte) and not arrhes. The booking therefore creates a firm commitment for both parties, subject to the provisions of these Terms concerning amendments and cancellations.
For any booking made more than 30 days before the start of the stay, an advance payment equal to 30% of the total amount of the services booked is payable at the time of booking. The balance must be paid no later than 30 days before the arrival date.
For any booking made 30 days or less before the arrival date, the full amount of the stay is payable at the time of booking.
If the balance is not paid by the due date, the campsite may, after a reminder has remained unanswered, treat the booking as cancelled by the customer and apply the cancellation charges set out in Article 7.
The accepted payment methods are those offered by the campsite at the time of payment.

5. No right of withdrawal
In accordance with Article L.221-28, 12° of the French Consumer Code, the right of withdrawal applicable to certain distance contracts does not apply to accommodation services, other than residential accommodation, provided on a specific date or during a specific period. Any booking for a stay on specified dates is therefore subject to these amendment and cancellation conditions.

6. Changes, late arrival and interruption of the stay
Any request to amend a booking must be sent to the campsite and is subject to availability. The campsite will endeavour to accommodate the request but cannot guarantee the availability of alternative accommodation, another pitch or different dates. An amendment may result in a price adjustment.

• Any extension of a stay is subject to availability and the rates in force.
• Any reduction in the length of the stay constitutes a partial cancellation and is subject to the applicable cancellation rules.
• Unless otherwise agreed in writing by the campsite, a stay cannot automatically be postponed to another date.
• Any stay interrupted or shortened, any delayed arrival or any early departure attributable to the customer does not entitle the customer to any refund or credit note, even in part, for booked services not used, except where otherwise required by law. If cancellation insurance has been taken out, the customer may seek compensation in accordance with the terms and limits of the insurance policy.

7. Cancellation and cancellation insurance
7.1 Cancellation of rental accommodation by the customer
If the booking is cancelled more than 30 days before the scheduled arrival date, the customer is liable, as compensation for termination of the contract, for an amount equal to 30% of the total cost of the stay, corresponding to the advance payment made at the time of booking.
If the booking is cancelled within the 30 days preceding the scheduled arrival date, or in the event of a no-show on the scheduled date, the full amount of the stay is payable.

7.2 Cancellation of a camping pitch by the customer
If the booking is cancelled more than 14 days before the scheduled arrival date, the customer is liable, as compensation for termination of the contract, for an amount equal to 30% of the total cost of the stay, corresponding to the advance payment made at the time of booking.
If the booking is cancelled within the 14 days preceding the scheduled arrival date, or in the event of a no-show on the scheduled date, the full amount of the stay is payable.

7.3 Cancellation insurance
Optional cancellation insurance may be offered at the time of booking. Where it is taken out, its cost and cover are separate from the price of the stay. Customers must refer to the insurer’s terms and conditions, available when the insurance is taken out, for details of covered events, exclusions, supporting documents, notification deadlines and compensation arrangements. The applicable price is shown in the current price list.

7.4 Cancellation by the campsite
If the campsite is required to cancel a stay for a reason attributable to it, any sums received for services not provided will be refunded, without prejudice to the consumer’s rights under mandatory legal provisions. In the event of force majeure, the consequences will be determined in accordance with applicable law.

8. Arrival, stay and departure
8.1 Pitches
Pitches are available from 12 noon on the day of arrival and must be vacated before 11 a.m. on the day of departure, unless otherwise agreed by the campsite. Outside the high season, these times may be adjusted depending on the campsite’s operational possibilities.

8.2 Rental accommodation
Rental accommodation is available from 5 p.m. on the day of arrival and must be vacated before 10 a.m. on the day of departure, unless otherwise agreed by the campsite.
Subject to availability, the campsite offers early check-in and late check-out options for rental accommodation for an additional charge. The applicable times, conditions and charges are those stated in the rates in force.

8.3 During the stay
Customers are responsible for their personal belongings and for anyone staying under their booking or visiting them. All occupants must comply with the campsite rules, safety instructions, the peace and quiet of other holidaymakers, and the rules governing use of the facilities.
Any problem or fault identified in rental accommodation must be reported to reception as soon as possible so that the campsite can take appropriate action.

8.4 Cleanliness and end-of-stay cleaning
If the end-of-stay cleaning service has not been booked, the accommodation must be left clean. Otherwise, the cleaning charge corresponding to the type of rental accommodation may be invoiced. The amount is stated in the current price list.

9. Customer liability and insurance
Customers are responsible for ensuring that they have third-party liability insurance covering any damage that may be caused by them or by persons for whom they are responsible during the stay. Subject to mandatory legal provisions, the campsite cannot be held liable for damage for which the customer is responsible, or for the theft, loss or deterioration of the customer’s personal belongings.

10. Pets
Cats are not permitted anywhere on the campsite.
Dogs are permitted subject to the supplement stated in the rates in force, with the exception of Category 1 and Category 2 dogs. Dogs must be declared, kept on a lead at all times and have an up-to-date vaccination record, which the campsite may ask to see.
Dogs are not permitted in Premium Cottages, in the aquatic area, or in any areas where their presence is prohibited by regulations or the campsite rules.

11. Visitors, facilities and safety
Visitor access and any applicable visitor charge are governed by the campsite rules and the rates in force. Access to the aquatic area is reserved for guests staying at the campsite.
Facilities, services and opening times may vary depending on the season or due to technical, weather-related, regulatory or safety constraints. Temporary unavailability of a facility does not automatically entitle the customer to a refund where it does not materially affect the accommodation service booked.
The use of barbecues, planchas and other cooking appliances is subject to the campsite rules, the campsite’s instructions and any prefectural or regulatory restrictions, particularly those relating to fire risk.

12. Campsite rules
The customer and all participants in the stay undertake to comply with the campsite rules and any specific rules applying to certain facilities. The campsite rules are displayed or made available by the campsite. Any serious or repeated breach may result in the measures provided for in those rules, without prejudice to payment of any amounts due for services.

13. Image rights
The taking and use of images in which a customer can be identified, for communication or promotional purposes, are not deemed to be authorised merely by acceptance of these Terms. Where necessary, separate consent appropriate to the purpose, media and period of use will be obtained.

14. Personal data
Personal data collected in connection with an enquiry, booking or stay are processed for the management of bookings, payments and stays, compliance with legal obligations, customer relations and, where permitted by law, marketing communications.
They are retained for the periods necessary for the purposes pursued and applicable legal obligations, and may be disclosed to service providers necessary for the performance of the stay and to public authorities where required by law.
Customers may exercise the rights granted to them under applicable data-protection legislation by contacting the campsite by post at the establishment’s address or using the contact details published by the campsite. Detailed information on the processing of personal data is set out in the applicable privacy policy.

15. Complaints and consumer mediation
Any complaint relating to the stay should be sent to Camping La Roucateille, preferably in writing, so that it can be processed and supporting evidence retained.
In accordance with Article L.612-1 of the French Consumer Code, after first submitting a written complaint to the campsite and subject to the conditions laid down by the French Consumer Code, the consumer may use the following consumer mediation service free of charge:

16. Telephone marketing
In accordance with applicable regulations, consumers who do not wish to receive commercial marketing calls may register free of charge on the Bloctel telephone marketing opt-out list.

17. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, the parties will first seek an amicable solution. Consumers retain the right to bring proceedings before the competent court in accordance with the applicable legal rules.

18. Pre-contract information and applicable version
The customer acknowledges having received, before the booking was concluded, the necessary information concerning the essential characteristics of the services, prices, payment arrangements, cancellation conditions and, where applicable, optional services.
The Terms applicable to the booking are those accepted by the customer on the date of booking. The campsite may amend these Terms for future bookings to reflect changes in its services or in applicable regulations.
