PREAMBLE
These terms and conditions govern the contractual relations relating to the sale of individual stays between the company LES CHALETS DU LAC BELCAIRE and its clients, in the campsite.
They cover all the steps necessary for making the reservation and payment of stays, and govern all follow-up between the contracting parties.
LES CHALETS DU LAC BELCAIRE makes its best efforts to ensure that its commercial documents, notably brochures, advertisements, and catalogs, are as faithful as possible to the services offered. However, it is possible that the Client’s perception of the photographic representation of services does not exactly correspond to the services themselves. Their purpose is therefore essentially informative. The General Terms and Conditions are notably accessible on the WEBSITE (www.camping-pyrenees-cathare.fr).

DEFINITIONS
“WEBSITE” refers to the website www.camping-pyrenees-cathare.fr, published by the company LES CHALETS DU LAC BELCAIRE SAS.
“LES CHALETS DU LAC BELCAIRE” refers to the company LES CHALETS DU LAC BELCAIRE SAS, a simplified joint-stock company with a capital of €50,000.00, registered with the Carcassonne Trade and Companies Register under number 948 687 942 00011, whose registered office is located at 4 Chemin du Lac 11340 BELCAIRE, represented by its legal representative in office.
“PITCHES” refers to the bare pitches rented for the installation of tents, caravans, or motorhomes of the CLIENTS in the campsite.
“RENTAL ACCOMMODATIONS” refers to all types of accommodation (chalets, huts, mobile homes, tents, etc.) excluding PITCHES, offered for rent in the campsite.
“STAYS” refers to the offer of a RENTAL ACCOMMODATION or a PITCH, accompanied, where applicable, by optional or paid additional services.
“CLIENT” refers to any person reserving a STAY and/or any services offered by LES CHALETS DU LAC BELCAIRE on the WEBSITE, or directly at the campsite. The CLIENT acknowledges having the capacity to contract, i.e., notably being of legal age and not subject to a protective measure, or, failing that, having the authorization of their guardian or curator if incapacitated.

ENTIRE AGREEMENT
These general conditions express the entirety of the obligations of the parties. In this sense, the CLIENT is deemed to accept them without reservation in accordance with the provisions of Article 1126 of the Civil Code.
These general conditions of rental and reservation of stays at LES CHALETS DU LAC BELCAIRE campsite apply to the exclusion of any other conditions.
They are accessible on the website www.camping-pyrenees-cathare.fr and shall prevail, if necessary, over any other version or contradictory document.
LES CHALETS DU LAC BELCAIRE and the CLIENT agree that these general conditions govern exclusively their relationship. LES CHALETS DU LAC BELCAIRE reserves the right to modify its general conditions from time to time. They will apply as soon as they are posted online.
If a rental or stay condition is missing, it shall be considered governed by the practices in force in the camping pitch rental and holiday village sector in France.

PURPOSE
These general conditions aim to define the rights and obligations of the parties within the framework of renting camping pitches, rental accommodations, or stays offered at LES CHALETS DU LAC BELCAIRE campsite to the client, via the website, by phone, by email, or directly on site.

SERVICES AND PRICES
The prices indicated are in euros, VAT included at the rate in force at the time of the reservation of the STAY. The total price of the STAY includes the rental price of PITCHES or RENTAL ACCOMMODATIONS, the selected additional services, booking fees, charges, and any cancellation insurance. This total price is indicated prior to the CLIENT’s validation of the reservation, whether made via the WEBSITE or any other booking channel. Any change in rates or evolution of applicable taxes at the time of billing may be passed on to the price of the stay.

1) Stay on a camping pitch:
LES CHALETS DU LAC BELCAIRE makes available to the client a bare PITCH, which can accommodate up to 6 people, for their tent, caravan, or motorhome (one caravan or motorhome per pitch). LES CHALETS DU LAC BELCAIRE offers different types of PITCHES whose descriptions are presented on the website. The minimum rental durations and rates vary according to the period; they can be consulted on the WEBSITE by entering the stay dates.

a) Price-services included
The price of the PITCH: It is the price of a bare PITCH per night of occupation to which is added the price of persons (adults or children) or additional elements present on the PITCH (electricity, vehicle, trailer, motorcycle, boat, additional tent or gazebo, awning, etc.) subject to a daily additional cost. All these rates are consultable on the WEBSITE by entering the stay dates. The base rate provides free access to sanitary facilities, reception, the swimming pool (during opening dates and hours), playgrounds, and the offered activities (free or paid). For safety reasons, the number of people arriving on the pitch cannot exceed its capacity. The campsite reserves the right to refuse access to any person exceeding the planned capacity.

b) Arrivals and departures at the campsite
PITCHES are available from 16:00 on the day of arrival and must be vacated before 11:00 on the day of departure. Any release after 11:00 may result in the billing of an additional night.

2) Stay in rental accommodation:
Descriptions, minimum rental durations, and rates vary depending on the period; they can be consulted on the WEBSITE by entering the desired dates and destination.

a) Price-services included
The rental price (including charges and additional fees) includes the accommodation, depending on the number of persons (according to capacity), utilities (water, gas, electricity), a vehicle, access to reception services, swimming pool (during opening dates and hours), playgrounds, other facilities, and offered activities (free or paid). For safety reasons, the number of people arriving in the accommodation cannot exceed its capacity. The campsite reserves the right to refuse access to any person exceeding the planned capacity. The RENTAL ACCOMMODATION must be returned clean and tidy at the end of the stay. RENTAL ACCOMMODATIONS are non-smoking.

b) Arrivals and departures at the campsite
RENTAL ACCOMMODATIONS are available from 16:00 on the day of arrival and must be vacated before 10:00 on the day of departure. Any late departure (after 10:00) will be billed €20 per hour. An additional fee may apply if the client wishes to arrive or depart outside the above hours (subject to availability). This fee must be requested at the time of booking.

TRANSFER AND SUBLETTING
All rentals are nominative; they cannot be transferred or sublet without prior agreement from LES CHALETS DU LAC BELCAIRE campsite.

TOURIST TAX
The tourist tax collected on behalf of the municipality and payable is not included in our rates. Its amount, determined per person, per age, and per night, may be modified during the year.

PROMOTIONS
Promotional offers are subject to certain conditions, notably availability. Furthermore, price reductions or promotional operations cannot be combined unless otherwise stated and are not retroactive. Some promotions are valid only through specific channels (website).
On such occasions, it is possible that for the same stay, clients may have paid different prices. Clients who paid the higher price will in no case be entitled to a refund of the difference between the price paid and the promotional price.

RESERVATION AND PAYMENT

1) RESERVATION CONDITIONS
The client may make their reservation online, by phone, by email, or directly at the reception, based on the presentation of pitches, accommodations, and services offered on the website www.camping-pyrenees-cathare.fr. Any reservation must be accompanied by:

a deposit, determined according to the reservation date, ranging from 30% to 100% of the total STAY price (rental only or rental with services),
any booking/file/annex fees and any subscription to cancellation-interruption insurance.
LES CHALETS DU LAC BELCAIRE draws the CLIENT’s attention to the fact that regardless of the chosen channel, the reservation becomes effective only after sending the written reservation confirmation by LES CHALETS DU LAC BELCAIRE, after receipt of the deposit and any applicable fees and insurance subscription.
This written reservation confirmation contains the details of the reservation made by the CLIENT as well as all information relating to their STAY.

2) SPECIAL CONDITIONS FOR WEBSITE RESERVATION
For orders placed on the WEBSITE, to validate the booking, the CLIENT must, after reviewing them, accept these General Terms by clicking the indicated spot and confirm payment.
After reservation, the CLIENT will receive a confirmation by email containing the details of the STAY (services, dates and duration, price, and payment terms).
Electronic signature applicable to online sales:
Providing the client’s credit card number online and final validation of the order constitutes proof of the client’s agreement:

obligation to pay the sums due for the reservation,
express signature and acceptance of all operations carried out.

3) PAYMENT OF BALANCE
In addition to the deposit paid at the time of reservation, the balance must be paid within the deadlines below:
The full STAY price for RENTAL ACCOMMODATIONS and PITCHES is due:

30 days before the start of the stay
immediately for any reservation made less than 30 days before the STAY
The full STAY price for RENTAL ACCOMMODATIONS and PITCHES is payable on the CLIENT’s arrival in case of same-day reservation at the reception.

Failure to pay within the above deadlines will result in the STAY being considered canceled by the CLIENT, and the cancellation fees in the CANCELLATION section will apply. If it is a non-cancellable/non-modifiable STAY, no refund will be given in accordance with the NON-CANCELLABLE AND NON-MODIFIABLE STAYS section.

4) RIGHT OF WITHDRAWAL
According to Article L. 221-28 12° of the Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering, and leisure services provided on a specific date or according to a specific schedule.

5) PAYMENT METHODS
For reservations on the WEBSITE, payment of the deposit or full stay is made by credit card (accepted cards: Carte Bleue, Visa, Eurocard/Mastercard). The transaction is immediately debited after verification of card information. Pursuant to Article L.132-2 of the Monetary and Financial Code, the payment commitment made by credit card is irrevocable. By providing credit card information, the CLIENT authorizes LES CHALETS DU LAC BELCAIRE to debit their card for the deposit or full stay. The CLIENT confirms being the cardholder and that the name on the card is theirs.
The balance may also be paid via the WEBSITE in the CLIENT’s personal account “my account,” which also provides order tracking. Accepted payment methods at the campsite: credit card, holiday vouchers, cash in euros only. Checks are not accepted at LES CHALETS DU LAC BELCAIRE.

ALLOCATION OF PITCHES / ACCOMMODATIONS
Allocation of PITCHES or RENTAL ACCOMMODATIONS is done without distinction in the order of bookings. LES CHALETS DU LAC BELCAIRE cannot guarantee that the requested PITCH or RENTAL ACCOMMODATION will be assigned unless the CLIENT selects the “preference” option during booking, subject to availability.
In case of force majeure, LES CHALETS DU LAC BELCAIRE may modify the allocation. Allocation of PITCHES is automatic based on equipment specified by the client during booking (small, medium, or large tent; caravan under or over 6 meters; motorhome under or over 6 meters; van/small camper). LES CHALETS DU LAC BELCAIRE is not responsible if the client provides incorrect information, and the assigned PITCH is unsuitable.

MODIFICATION OF STAY
Modification by the CLIENT: Any change of dates, destination, or type of accommodation is considered a modification of the STAY. Modifications are valid for 6 months but only within the current financial year at LES CHALETS DU LAC BELCAIRE campsite. No extension beyond this period is possible. If the price of the new STAY is higher than the initial STAY, the CLIENT must pay the difference. Conversely, no refund will be issued for a lower price difference.

Modification of the STAY is possible for a flat fee of €50 and up to 30 days before arrival.

Requests to modify services included in the STAY may be sent by the CLIENT by email and received by LES CHALETS DU LAC BELCAIRE before the modification deadline (30 days before arrival). In this case, LES CHALETS DU LAC BELCAIRE will make every effort to accommodate the request according to campsite availability. Requests received less than 30 days before arrival will not be refunded.

Modification by the campsite: If LES CHALETS DU LAC BELCAIRE must modify the initially planned services, it will endeavor to provide similar services; the CLIENT may either accept the modification or cancel the contract and obtain a refund of amounts paid, under the conditions of Article L 214-1 of the Consumer Code.

CANCELLATION OF STAY
Cancellation by the campsite (excluding force majeure): In case of cancellation before the CLIENT leaves their residence for the campsite, amounts paid will be fully refunded by LES CHALETS DU LAC BELCAIRE upon notification by email or registered mail.
In case of cancellation after the CLIENT departs for the campsite and within 24 hours before the start of the STAY, LES CHALETS DU LAC BELCAIRE undertakes to offer an equivalent STAY, covering any additional costs. If the accepted services are of lower quality, LES CHALETS DU LAC BELCAIRE will refund the difference.

Cancellation (total or partial) by the CLIENT: If the CLIENT wishes to cancel, they must notify LES CHALETS DU LAC BELCAIRE by email. Failure to cancel according to this section obliges the CLIENT to pay the full contract amount. Filing and insurance fees, if any, are non-refundable. The date of receipt of the cancellation email determines applicable fees as follows:

• 30% fee up to 30 days before arrival
• 100% fee from 29 days before arrival

Non-use of additional services: Additional services reserved by the CLIENT but not used for their own reasons are not refundable.

NON-CANCELLABLE AND NON-MODIFIABLE STAYS / OFFERS / RATES
LES CHALETS DU LAC BELCAIRE may offer STAYS at preferential rates on specific dates that are non-modifiable, non-refundable, and non-exchangeable.
Consequently, no request for modification or cancellation will be accepted: no refund, including for additional services reserved.

CANCELLATION AND INTERRUPTION INSURANCE
Cancellation and interruption insurance is optional but CLIENTS are encouraged to subscribe at booking. Its cost is a percentage of the total stay (with possible minimum billing).
This insurance covers, under conditions, stay cancellations, late arrival, interruption, or forgotten items. Full clauses of the insurance contract are available upon request and on our website. For a claim, notify via www.declare.fr, email sinistres@campez-couvert.com, or mail: Gritchen Affinity – Sinistre – Campez Couvert – 27 rue Charles Durand - CS 710139 - 18021 BOURGES Cedex.
According to Article L121-4 of the Insurance Code, if multiple policies are contracted without fraud, each applies within its coverage limits and respecting Article L121-1.

LATE ARRIVAL, EARLY DEPARTURE
Without prior notice from the CLIENT, the PITCH or RENTAL ACCOMMODATION becomes available 24h after the scheduled arrival date, and full payment remains due.
No refund will be granted for early departure (see insurance options for reimbursement).

SECURITY DEPOSIT
For any RENTAL ACCOMMODATION, a deposit of €320 is required no later than arrival. Payment is by credit card. It will be returned in full on departure or within eight days, after inspection of cleaning and equipment. The accommodation must be returned in perfect cleanliness (washed and put away dishes, emptied bins, etc.).
If cleaning is not performed according to the inventory/checklist given at arrival, a flat cleaning fee will be automatically deducted from the deposit. This fee is fixed per item or equipment according to the schedule provided at arrival and constitutes compensation for observed deficiencies:

• Disposable bed protector not removed: €5
• Trash not emptied: €5
• Broom/vacuum not used: €15
• Mop not used: €20
• Toilet not cleaned: €10
• Shower not cleaned (drain, etc.): €10
• Washbasin not cleaned: €5
• Sink not cleaned: €5
• Dishes not washed: €10
• Dishes not dried: €10
• Dishes not put away: €10
• Appliances not cleaned: €5
• Cooking plate not cleaned: €10
• Bed linen not removed (in case of rental or subscription to a package): €5

Damages exceeding the deposit will be charged to the CLIENT after deposit deduction.

CLEANING

The CLIENT is required to return their RENTAL ACCOMMODATION in perfect cleanliness at the end of the stay. The CLIENT may request that cleaning be carried out by our staff, subject to payment of a cleaning fee on site. However, the choice of this cleaning fee or the subscription to a package (Hotel, Premium, or Confort+) does not release the CLIENT from certain essential obligations which remain their responsibility. To this end, the CLIENT must, in addition to the cleaning carried out by our staff or included in the Premium package, perform certain tasks explicitly indicated in the documents provided upon arrival, notably:

• Remove and dispose of disposable bed protections,
• Empty all trash bins,
• Wash, dry, and put away the dishes,
•  
• In case of sheet rental or subscription to a package (Hotel, Premium, or Confort+), remove the sheets and place them in the bag provided for this purpose.

Failure to comply with these obligations, even if the cleaning fee has been subscribed to or if the CLIENT has opted for any package, may result in the deduction of a flat-rate amount from the security deposit, in accordance with the scale communicated to the CLIENT upon delivery of the inventory at arrival. This deduction constitutes a flat-rate compensation per item for the observed breaches and does not exclude the campsite from claiming, where appropriate, additional damages if the damages exceed the amount of the security deposit.

LEISURE ACTIVITIES
Any free or paid activity mentioned on the WEBSITE, email, or on-site may be modified or canceled upon arrival.

MINORS
Unaccompanied minors are not accepted unless parental authorization is provided.

ANIMALS
One pet per RENTAL ACCOMMODATION is allowed for an extra nightly fee not included in accommodation rates.
The CLIENT must declare pets at booking or on arrival. Animals must be leashed and are not allowed in communal areas. Pets must be vaccinated and identified (tattoo or chip). Dangerous or aggressive animals (1st and 2nd category dogs) and “new companion animals” are not accepted.

HOUSE RULES
A house rules document is available at reception. Non-compliance may result in contract termination without refund.

PERSONAL DATA
Client information is confidential, used only internally for booking and stay management. Clients have rights of access, correction, and opposition under the French Data Protection Law. Requests must be sent to LES CHALETS DU LAC BELCAIRE, 4 Chemin du Lac, 11340 BELCAIRE.

LIABILITY OF LES CHALETS DU LAC BELCAIRE
All photos and texts in brochures or on the website are non-contractual and indicative. Certain activities or facilities may be removed for weather or force majeure reasons.

FORCE MAJEURE
Events beyond control, unforeseeable, unavoidable, and independent of the parties relieve contractual obligations (Article 1218 Civil Code). Parties will assess and adjust contract execution. Force majeure longer than three weeks leads to automatic contract termination.

PARTIAL INVALIDITY
If one or more provisions are invalid, others remain in force.

NON-WAIVER
Failure to enforce a provision does not constitute a waiver.

CONTRACT LANGUAGE
The contract is in French. In case of translation, the French text prevails.

DISPUTE RESOLUTION – MEDIATION
For French and EU citizens, parties will attempt amicable resolution. Complaints must be sent by registered mail or email within one month of the stay.

APPLICABLE LAW
These terms are governed by French law, subject to mandatory provisions.
