GENERAL TERMS AND CONDITIONS OF SALE — 2027 SEASON

Article 1 — Scope, operator and contractual documents
1.1 Scope
These General Terms and Conditions of Sale (hereinafter the “GTCS”) apply to stays in rental accommodation or on a pitch booked directly with one of the campsites of the CAMPASUN group, online, by telephone or at reception. Stays booked through a tour operator or another intermediary are governed by Article 16.

1.2 Identification of the operator (contracting party)
The contract is entered into between the Customer and the company operating the booked campsite (hereinafter the “Campsite”), identified below. Its contact details also appear on the order summary and on the booking confirmation.

1.3 Contractual documents and order of precedence
The contract consists of the following documents:

1. the booking confirmation (accommodation or pitch, dates, participants, options, total price);

2. the specific conditions of the booked campsite, which set out in particular whether or not animals are admitted, opening hours, facilities, supplements and opening dates;

3. these GTCS;

4. the campsite rules, drawn up in accordance with the regulatory model, which govern life on the site and are binding on every person present at the Campsite.

In the event of any inconsistency, the specific conditions of the campsite prevail over the GTCS.

1.4 Applicable version
The applicable version of the GTCS is the one accepted by the Customer at the time of booking. The Campsite may amend its GTCS; amendments do not apply to bookings already confirmed.

Article 2 — Acceptance of the terms and conclusion of the contract
2.1 Provisional booking
A booking made other than through the website may be held provisionally free of charge for 72 hours from the time the Campsite sends the quotation.
To confirm the booking, the customer pays the advance payment before this period expires. Payment may be made by bank transfer, bank card, ANCV Connect or ANCV holiday vouchers (Chèques-Vacances). Where payment is sent by post, proof of posting must be sent by e-mail within 72 hours.
If no payment has been received by the end of this period, the provisional booking is automatically cancelled and the accommodation or pitch is put back on sale. The booking becomes binding upon receipt of the advance payment.
2.2 Acceptance according to the booking method
Before making any booking, the Customer accepts the GTCS, the specific conditions of the campsite and the campsite rules:

  •      Online: after checking and, where necessary, correcting the summary of the order (dates, participants, options, total price), by ticking a box that is not pre-ticked, then confirming by clicking a button labelled “Order with obligation to pay”.
  •      By telephone: on the payment page of the link sent by the Campsite by e-mail together with these documents, within 48 hours. Where the call was initiated by the Campsite, the Customer is bound only after accepting the offer in writing (Article L. 221-16 of the French Consumer Code).
  •      At reception: these documents are displayed at reception and handed to the Customer on request or sent by e-mail before payment; payment for the stay constitutes acceptance, as stated on the summary or receipt given to the Customer.

The booking becomes binding upon payment of the amount due (Article 5).

2.3 Confirmation
The Campsite sends the Customer a booking confirmation on a durable medium (e-mail), setting out the characteristics of the stay and the total price, to which the GTCS, the specific conditions and the campsite rules are attached.

2.4 Participants in the stay
The Customer informs the persons staying with him or her of these GTCS, the specific conditions and the campsite rules, and ensures that they comply with them. The Customer is liable for any breaches committed by these persons and by his or her visitors.

Article 3 — Booking
3.1 Terms and refusal
The Campsite may refuse a booking for a legitimate reason, in particular: lack of availability, a request exceeding the capacity of the accommodation or pitch, a group request that does not comply with Article 3.4, an abnormal request, non-payment or a serious breach of the campsite rules during a previous stay. No refusal is based on a discriminatory criterion.

3.2 Personal nature of the booking and accuracy of information
The booking is made in the Customer's name and is strictly personal: it may not be sublet or assigned without the prior written consent of the Campsite. The Customer must be of legal age, be one of the guests staying at the Campsite and provide the surnames, first names and dates of birth of all participants, including minors and newborns. This information makes it possible to apply age-based rates and the tourist tax and to comply with the capacity of the accommodation.

If inaccurate information affects the price, capacity or safety, the Campsite invites the Customer to resolve the issue by paying any additional amount due and ensuring that the maximum occupancy is respected. If the issue is not resolved, the Campsite may refuse access to undeclared persons and, if the maximum capacity remains exceeded, apply Article 10.5.

Minors. Minors must be accompanied by one of their legal representatives or by an adult taking part in the stay and holding a written authorisation from a legal representative. Unaccompanied minors are not admitted. Minors remain under the full and permanent responsibility of the accompanying adult for the entire duration of the stay, including in the pool area.

3.3 Number of occupants
For safety and insurance reasons, the number of occupants of a rental accommodation or pitch may not exceed the capacity stated at the time of booking, newborns included.

3.4 Group bookings
A group booking is a booking of more than three accommodation units or pitches for the same dates, by the same person or by several persons travelling together. In order to preserve the peace and quiet of all holidaymakers, any group booking request must be sent by e-mail to the campsite concerned. The Campsite may accept it, refuse it for a legitimate reason relating to its size, its purpose or the capacity of the site, or accept it subject to specific conditions (adult contact person, location of the accommodation units, additional security deposit).

If the Campsite finds that separate bookings in fact constitute an undeclared group booking, it may offer the Customer the conditions applicable to groups or, failing agreement, cancel the bookings concerned and refund all sums paid in full.

3.5 Animals
The admission of animals depends on the campsite and on the accommodation booked. Some campsites or accommodation units do not accept them: the specific conditions of the campsite and the description of the accommodation indicate this before booking and prevail over this article.

At campsites and in accommodation units that accept them:

  •      only dogs and cats are admitted, limited to one animal per accommodation unit or pitch;
  •      the animal must be declared at the time of booking and, where applicable, is subject to the supplement provided for in the specific conditions;
  •      the animal must be identified and vaccinated against rabies; on arrival, the Customer presents the animal's up-to-date passport or health record;
  •      Category 1 and Category 2 dogs within the meaning of Article L. 211-12 of the French Rural and Maritime Fishing Code are not admitted;
  •      dogs must be kept on a lead within the Campsite; no animal may be left alone, tied up or shut in a vehicle or accommodation unit;
  •      animals are not admitted to the pool area, the shared sanitary facilities or the play areas.
  •      Pets are not allowed on sofas, beds or blankets. Where a significant amount of hair requires specific cleaning, additional charges may be invoiced.

An animal that has not been declared or that does not comply with these rules may be refused access; if no solution can be found, Article 10.5 applies.

Guide dogs and assistance dogs. Guide dogs for the blind and assistance dogs accompanying a person with a disability are admitted to all campsites, including those that do not accept animals, free of charge, in accordance with Article 88 of Law No. 87-588 of 30 July 1987. They are not admitted to the pools. The Customer is invited to report their presence at the time of booking in order so that appropriate arrangements can be made for their arrival.

Article 4 — Prices and rates
Prices are stated in euros, inclusive of all taxes. The total price displayed before the booking is confirmed includes the price of the stay and all mandatory fees and supplements: booking fee, environmental contribution, supplements for additional persons, animals or vehicles, and tourist tax. Where the exact amount of the tourist tax cannot be calculated in advance, the method of calculation is indicated. Optional extras (cancellation insurance, linen hire, cleaning option where available, etc.) are presented separately and are added only at the Customer's request.

Prices are calculated on the basis of the VAT rate in force on the date of booking. Any change in the applicable VAT rate is passed on, whether upwards or downwards, to sums collected after the change takes effect.

“Partner” benefits and promotional offers cannot be combined with one another, unless otherwise stated, and do not apply to a booking that has already been paid in full or in part. No refund of a price difference may be claimed by a Customer who has paid a higher price than another Customer for a comparable stay.

4.1 Tourist tax
The tourist tax is collected by the Campsite on behalf of the competent local authority. It is payable per adult and per night, at the rate set by resolution of the local authority, and appears on the invoice. Its amount may change following a decision of the local authority; the applicable amount is the one in force on the date of the stay.

4.2 Environmental contribution
An environmental contribution of €0.80 per person per day of stay is payable for every stay. It is not a public tax: it is collected by the Campsite and contributes in particular to the costs it incurs for the collection, sorting and treatment of waste.

Article 5 — Payment terms and methods
5.1 Booking of rental accommodation
•      For bookings made more than 30 days before arrival, an advance payment of 30% of the total price of the stay is required. This payment includes the €10 booking fee. Any cancellation insurance premium is payable in addition (Article 6).

5.2 Booking of a pitch
•      Booking more than 30 days before arrival: advance payment of €140 (or of the total price if lower), plus the €10 booking fee and, where applicable, the cancellation insurance premium.

In both cases, the balance must be paid no later than 30 days before arrival; for a booking made 30 days or less before arrival, the total price is payable at the time of booking.

5.3 Nature of the sums paid
The sums paid before the stay are advance payments (acomptes): the booking is definitively binding on both the Customer and the Campsite. The booking fee covers the processing of the booking and is non-refundable, except in the cases provided for in Article 7.4.

5.4 Failure to pay the balance
If the balance is not received by the due date, the Campsite sends the Customer a reminder by e-mail, which constitutes formal notice and grants the Customer 8 days to pay the outstanding balance. Failing payment within this period, the booking is automatically cancelled, without any further formality, and the Campsite informs the Customer accordingly. The sums paid are then retained under the conditions of Article 7.1. The treatment of any insurance premium paid is governed by the insurance contract (Article 6).

5.5 Payment methods
Payment may be made:

  •      by bank card, via the secure payment system of the Campsite's website, by secure payment link or at reception;
  •      by Apple Pay or Google Pay;
  •      in 4 instalments via FLOA Bank, subject to acceptance of the application by FLOA and under the conditions (amounts, time limits) presented by FLOA before any commitment. This instalment payment is a credit granted by FLOA, subject to the rules on consumer credit, in particular the 14-day right of withdrawal specific to the credit agreement. Taking out credit is a commitment and must be repaid. Check your ability to repay before committing;
  •      by bank transfer, the funds having to be received no later than the relevant due date;
  •      by paper holiday vouchers or Chèque-Vacances Connect (ANCV). Paper holiday vouchers must be sent by registered post with acknowledgement of receipt and must be received by the Campsite no later than 30 days before arrival. No change is given on holiday vouchers;
  •      in cash, at reception only, up to a limit of €1,000 per stay, regardless of the Customer's country of residence.

For any booking made 30 days or less before arrival, paper holiday vouchers and cash are not accepted.

Article 6 — Cancellation and curtailment insurance (Neat)
The Campsite offers, on an optional basis, cancellation and curtailment insurance distributed by Neat, an insurance broker, and underwritten by the insurer named in the policy. The insurance contract is entered into between the Customer and the insurer: the Campsite is not the insurer and does not decide on compensation.

Taking out insurance. The insurance is taken out at the time of booking. Before taking out the insurance, the Customer receives, in accordance with Article L. 112-2 of the French Insurance Code, the standardised insurance product information document and the general terms and conditions of the policy, which alone determine the cover, exclusions, limits, excesses, notification deadlines and supporting documents required.

Premium. The premium amounts to 4.50% of the total amount of the stay. It is paid together with the advance payment and collected by the Campsite on behalf of Neat and the insurer. Any refund of the premium is governed exclusively by the insurance contract.

Cover. Subject to the terms of the policy, the insurance may in particular cover:

  •      cancellation for a covered and substantiated reason: reimbursement of the sums retained by the Campsite, less the excess and within the limits of cover;
  •      cancellation without supporting documents: partial reimbursement, up to the percentage set by the policy (70% at the date hereof), within the limits and subject to the exclusions provided for in the policy.

In the event of a claim, the Customer informs the Campsite of the cancellation (Article 7.1) and notifies the claim to Neat, at sinistre@neat.eu, within the time limit and with the supporting documents provided for in the policy.

Article 7 — Cancellation, modification and curtailment of the stay
7.1 Cancellation by the Customer
Any cancellation must be notified in writing to the campsite concerned, by e-mail to the address indicated in the specific conditions. The cancellation takes effect on the date the Campsite receives the notice. Whatever the reason for the cancellation, the sums paid as at that date (advance payment, booking fee and, where applicable, balance) are retained by the Campsite, subject to Article 7.4. The Campsite does not claim any balance that was not yet due.

A Customer who has taken out cancellation insurance is compensated by the insurer under the terms of the policy (Article 6).

7.2 Modification by the Customer
Any request for modification (dates, accommodation category, options) must be sent by e-mail to the campsite concerned no later than 10 days before the start of the stay. After this deadline, the stay can no longer be modified. The request is handled subject to availability and at the rates in force on the date of the request. If the new stay is more expensive, the Customer pays the difference; if it is less expensive, the difference is not refunded. A reduction in the length of the stay or in the number of participants constitutes a partial cancellation subject to Article 7.1.

7.3 Late arrival and early departure
No reduction or refund is granted in the event of late arrival or early departure attributable to the Customer. In the absence of a message from the Customer reporting a delay, the accommodation or pitch may be reallocated 24 hours after the scheduled arrival date, the sums paid being retained by the Campsite.

7.4 Cancellation or curtailment by the Campsite
Cancellation by the Campsite. If the Campsite cancels a confirmed booking for a reason other than force majeure or a breach by the Customer, it refunds all sums paid in full, including the booking fee.

Force majeure and administrative closure. If an event of force majeure within the meaning of Article 1218 of the French Civil Code or an administrative decision (closure, evacuation, ban on access) prevents the Campsite from performing all or part of the stay, the contract is terminated for the unperformed part. The Campsite refunds the sums corresponding to the services not provided (including the booking fee if the stay has not begun), without any further compensation. With the Customer's agreement, it may offer a postponement or a credit note instead of a refund.

Unavailability of a facility. If a facility or service presented as included in the stay (the pool area, for example) is unavailable, the Customer may request a proportionate price reduction, in accordance with Article 1223 of the French Civil Code. A brief, one-off closure for reasons of safety, weather or routine maintenance does not give rise to any right to a reduction.

Article 8 — No right of withdrawal
In accordance with Article L. 221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to contracts for the provision of accommodation services, other than for residential purposes, and of leisure activities, where the contract provides for a specific date or period of performance. Only the cancellation conditions of Article 7 apply. Cancellation insurance and instalment payment are governed by their own rules (Articles 5.5 and 6).

Article 9 — Arrival, departure, security deposit and cleaning
9.1 Times
On arrival, every Customer must report to the Campsite reception.

  •      Pitch: arrival between 2 p.m. and 7 p.m.; departure before 12 noon.
  •      Rental accommodation: arrival between 4 p.m. and 7 p.m.; departure between 8 a.m. and 10 a.m. The appointment for the check-out inspection is to be arranged with reception 48 hours before your departure.

The specific conditions may provide for other times. Exceeding the departure time may result in an additional night being invoiced at the rate in force, after the Customer has been informed.

9.2 Security deposit
A security deposit is required on arrival, by bank card. It takes the form of a pre-authorisation (a temporary hold on the card) on the Customer's card, without any debit.

Its amount depends on the category of accommodation stated in its description and repeated in the booking summary:

Category
Security deposit
Chalets and mobile homes, all capacities
€500
Fully equipped tents, with or without sanitary facilities, and traditional wooden caravans
€400
Other alternative accommodation; pitches with private sanitary facilities
€200

In the event of arrival after reception has closed, the security deposit is provided remotely, before the keys are handed over.

Release. After the check-out inspection, and no later than 7 days after the Customer's departure, the unused portion of the pre-authorisation is released after any justified charges have been applied; the time taken for the card limit to be updated then depends on the Customer's bank.

Deductions. In the event of damage, loss (keys, badges), items missing from the inventory or cleaning not carried out (Article 9.3), the Campsite may retain the corresponding sums. Each deduction is substantiated by the inventory and condition report, photographs and an invoice or quotation. The Campsite provides the Customer, in writing, with details of the deductions and the supporting documents no later than at the time of release. If the Customer leaves without a joint check-out inspection, the inspection is carried out by the Campsite in the Customer's absence, supported by photographs, and sent to the Customer, who may dispute it in writing. If the cost of repairs exceeds the amount of the security deposit, the Customer remains liable for the difference upon presentation of supporting documents.

9.3 Cleanliness and cleaning fee
The accommodation must be returned in the same state of cleanliness as found on arrival: crockery clean and put away, refrigerator emptied and cleaned, bins emptied, floors swept, sanitary facilities cleaned. Failing this, as recorded during the check-out inspection, a cleaning fee is invoiced according to the scale below, unless the Customer has taken out a cleaning option.

The fee is determined first by the type of accommodation. For chalets and mobile homes, it depends on the capacity and facilities; where a chalet or mobile home falls under more than one line, the highest amount applies.

 The applicable amount is stated in the description of the accommodation and in the booking summary.

Accommodation
Cleaning fee
Fully equipped tents without sanitary facilities, other alternative accommodation without sanitary facilities, pitches with private sanitary facilities
€65
2-person mobile homes, fully equipped tents with sanitary facilities, traditional wooden caravans and other alternative accommodation with sanitary facilities
€80
Chalets and mobile homes for 4 persons or more
€100
Chalets and mobile homes for 4 persons or more, with private hot tub or with 2 bathrooms
€130

Cleanliness on arrival. If the accommodation is not clean on arrival, the Customer reports this to reception as soon as possible, preferably before settling in and no later than within 24 hours, so that the Campsite can remedy the situation promptly. Late reporting makes verification more difficult but does not deprive the Customer of his or her rights.

Article 10 — During your stay
10.1 Campsite rules and peace and quiet
Every holidaymaker must respect the campsite rules, the facilities and the peace and quiet of the Campsite. Silence must be observed from 10 p.m. to 7 a.m. Evening events and entertainment organised by the Campsite may continue until 11 p.m. at the latest.

For reasons of electrical safety, charging electric vehicles (cars and motorised two-wheelers) is prohibited at pitch electrical hook-ups and at the sockets of rental accommodation; it is only permitted at dedicated charging points, where the campsite has them. Any breach falls under Article 10.5.

10.2 Access to the Campsite and visitors
Only the persons named on the booking may stay at the Campsite. Visitors may be admitted with the authorisation of reception, to which they must be declared before their arrival, under the responsibility of the Customer receiving them. Where applicable, they pay the visitor fee displayed at reception. Their vehicles must remain outside the Campsite and they are not permitted to use the pool area.

10.3 Rules of conduct on site
The use of charcoal barbecues is prohibited. The Customer must also comply with prefectoral restrictions relating to the risk of fire.

Smoking is prohibited inside the rental accommodation. In the event of non-compliance with this prohibition, the Campsite reserves the right to deduct from the security deposit all or part of the sums required to restore the accommodation, in particular the costs of deep cleaning, deodorising and redecorating made necessary by the presence of tobacco odours or traces of smoke. This deduction may be made independently of any deduction relating to a failure to carry out end-of-stay cleaning.

10.4 Photographs and descriptions
The photographs and plans of the accommodation shown in promotional materials (website, brochures) are representative of the category, but the layout may vary from one model to another. The essential characteristics of each accommodation unit (capacity, number of bedrooms and bathrooms, facilities) are those set out in the written description presented at the time of booking, which is binding on the Campsite.

10.5 Breaches and sanctions
If the Customer, a participant or a visitor disturbs the stay of other holidaymakers or fails to comply with the campsite rules or these GTCS, the Campsite may, orally or in writing, give formal notice to cease the disturbance. In the event of a serious breach, or a breach repeated after formal notice, the Campsite may terminate the contract; the Customer and the participants must then leave the Campsite within the time limit set by the management. Where there is a danger to persons or property, termination may take effect immediately. In the event of a criminal offence, the Campsite may call the police.

In the event of termination for breach, unused nights are not refunded and Article 9.2 applies to the security deposit.

Article 11 — Liability
The Campsite is liable for the proper performance of the services booked, in accordance with the generally applicable rules of French law. It is not liable for:

  •      theft, loss or damage to personal belongings and vehicles occurring in the accommodation, on the pitches, in the car parks or in the shared facilities, unless due to its own fault; the car parks are not supervised;
  •      damage caused by the Customer, the participants or their visitors, or resulting from the act of a third party or from force majeure.

No provision of these GTCS limits the Campsite's liability in the event of personal injury.

It is the Customer's responsibility to hold insurance covering his or her civil liability (including damage caused to third parties, to the accommodation or to the Campsite's facilities) and, if so desired, the loss, theft or damage of personal belongings. The Customer is invited to check with his or her insurer that this cover applies during the stay, in particular under his or her home insurance policy or a “holiday” extension.

Only information published or provided by the Campsite (website, specific conditions, booking confirmation) is binding on it. The Campsite is not responsible for photographs or information concerning the Campsite published by third parties without its consent.

Article 12 — Complaints
Any incident occurring during the stay should, as far as possible, be reported without delay to the reception of the campsite concerned, so that it can be remedied on site. If no solution is found on site, the Customer may send a written complaint, by e-mail or by post, to the campsite where he or she stayed. The Campsite endeavours to respond within 30 days. An incident that was not reported during the stay may be more difficult to verify, but the Customer retains the possibility of submitting a complaint.

Article 13 — Image rights
The Campsite may photograph or film its facilities and entertainment for its communication materials. It only uses the image of an identifiable Customer or participant for promotional purposes with that person's prior written authorisation, obtained separately from these GTCS (form in the appendix). For a minor, the authorisation is given by both legal representatives, who jointly protect the minor's image rights (Article 372-1 of the French Civil Code), or by the person exercising sole parental authority. Refusal to give this authorisation has no effect on the stay.

The authorisation is given free of charge. It specifies the media concerned (website, brochures, social media channels) and its duration, which may not exceed 5 years. It may be withdrawn at any time by e-mail to the Campsite's address indicated in Article 1.2. Withdrawal puts an end to any new use; online publications controlled by the Campsite are removed within 30 days. Printed materials already distributed cannot be recalled.

A person who has not given authorisation and who appears in an identifiable manner in a photograph or video is not shown in the Campsite's publications, or his or her image is blurred.

Article 14 — Personal data protection

Article 15 — Mediation, governing law and jurisdiction
Mediation. If no amicable solution is reached following the written complaint provided for in Article 12, the Customer may refer the matter, free of charge, to the consumer mediator to which the Campsite belongs (Articles L. 612-1 et seq. of the French Consumer Code), within one year of that complaint:

Governing law. These GTCS and the contracts entered into under them are governed by French law.

Failing an amicable resolution, the consumer Customer may bring proceedings, at his or her choice, before the court having territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where he or she resided at the time the contract was concluded or the harmful event occurred (Article R. 631-3 of the French Consumer Code).

Article 16 — Bookings through a tour operator or another intermediary
Tour operator or agency selling the stay in its own name. The contract for the stay is entered into with the tour operator or agency. Its terms of sale govern booking, payment, modification and cancellation, and it is the Customer's point of contact on these matters. During the stay, the Customer complies with the campsite rules and the specific conditions of the campsite (times, animals, security deposit) and pays on site the tourist tax and any charges which, under the tour operator's contract, are not included in its price.

Booking platform acting on behalf of the Campsite. The contract is entered into with the Campsite. The price, payment and cancellation conditions displayed by the platform at the time of booking apply; these GTCS apply to all other matters.

Article 17 — Severability
If any clause of these GTCS is declared null and void or deemed to have no effect, the other clauses remain fully valid.
